Tax in Spain is frightening until someone explains it

Fear of Hacienda comes from not knowing what it sees and what it will ask. So we start there: what Spain already knows about you, what it can ask, and what you will answer with.

Recently a founder told me his gestor's advice: run everything through the UK company and don't worry. For five years he had lived in Germany on paper and spent long stretches in Spain. Spain counts every one of those days, even part of a day. In residency cases, inspectors have rebuilt a person's year day by day from flight records, card payments and photos posted on social media.

Nothing had happened yet. If Hacienda ever asks, the answer should already be in a folder.

And if the folder shows Spain was home after all, filing first is the cheap way out. On €15,600 of tax for one year, filing and paying five months late on your own adds €702. If Hacienda finds it two years later, it adds €6,181 with every discount, and €12,968 without.

The folder you hope never to need

  • A certificate of tax residence from your other country, issued for treaty purposes, one for each year
  • Your home there: the lease or deed, and where your family lives
  • A log of your days in and out of Spain
  • Where your company is managed, and the papers that show it
  • Where your money came from, for your bank and for Hacienda

Registering before choosing a regime

What it costsThe Beckham route closes: −⁠€10,800 a year on €120,000 of pay, for up to six years.

What the plan does firstThe route comes first: director of your company, employee, or entrepreneur with an ENISA report issued before you move. Hacienda can check that the role is the reason you moved. Modelo 149 goes in within six months of the start date on your Social Security registration.

A company abroad, run from here

What it costsIf the whole business is managed from Spain, Spanish corporate tax on all its profit for up to four past years, with interest and a penalty. If you control it and it pays less than three quarters of what Spanish corporate tax would be, some or all of its profit can be taxed in your hands.

Forms for crypto and accounts abroad, missed

What it costsModelo 720 or 721: €20 per data item, −⁠€300 to −⁠€20,000. Half if you file before Hacienda asks.

Crypto sold without a tax plan

What it costs19% to 30% of the gain: €26,480 on a €120,000 gain, due by 30 June next year, or 60% then and 40% in November. Your bank asks where the money came from.

Residency claimed for past years

What it costsSpanish tax on your worldwide income for each year still open, four years from its filing deadline, with interest. Tax paid abroad counts only where the treaty let that country tax you. If Hacienda finds it first, a penalty of 50% to 150% can follow.

What the plan does firstA treaty residence certificate from your other country for each year, proof of your home there, a log of days and a clear start date in Spain. If you file before Hacienda asks, a surcharge of 1% to 15% replaces the penalty.

A letter nobody opened

What it costsIf you get notices electronically, one counts as delivered after ten days, opened or not. The letter sets the deadline to reply, and it can be as short as ten working days.

What the plan does firstWith a power of attorney that covers notices, they reach me too, and I prepare the reply.

A permit tied to one job or one status

What it costsA self-employed permit is renewed only if your tax and Social Security are in order. Switch from your job to self-employment and Beckham ends.

What the plan does firstReturns and Social Security in order well before renewal day, and the tax side of any change of job or permit worked out before you make it. For the renewal or the change I prepare the file, business plan included, and a partner lawyer files it.

A gestor who files without asking

What it costsRent filed from Hacienda's draft loses the deduction for renting a home, 50% to 90% of the net rent: one client lost −⁠€9,000 in a year. Returns that were never filed can hold up a residency renewal.

What the plan does firstI ask before I file: every property, account and income, with its documents. Missed returns go in before anyone asks.

    Questions before you pay

    Are you a lawyer?

    No. I am a tax adviser, which in Spain is an open profession, and filings for a client go through a power of attorney registered with the tax agency. Court cases need a lawyer and deeds need a notary. For those I find one and hand over the file.

    Do I give you my passwords?

    No. You register a power of attorney from your own Cl@ve in about ten minutes, for named actions and a fixed term, and you can revoke it yourself. If it covers notices, electronic letters from Hacienda reach me too.

    Who is responsible if something goes wrong?

    A one-page agreement you read before paying. It sets what I answer for, what you answer for and the date your documents are due.

    Will you help me cash out crypto?

    I calculate the gain, file Modelo 721 and prepare the source-of-funds file your bank asks for. Spanish tax advisers must check where money comes from (Law 10/2010), so we start with your identity and the source of funds. If the origin cannot be shown, I tell you in the first call.

    When is someone else the better choice?

    A law firm for court cases and company deals. A local gestoría for company books and payroll. A tax app if your income is one Spanish salary and nothing abroad. I say so in the first call if that is your case.

    How do sessions and payment work?

    By video, or in person on the Costa del Sol. You pay by bank transfer against an invoice before the first session.

    Can you handle my residency renewal or a change of permit?

    Yes. I prepare the file with you: the documents and, for a change of permit, the business plan. A partner lawyer files the application, and I stay your one contact until the decision. The tax side comes with it: returns and Social Security in order, and what the change means for your tax.

    I moved mid-year. Does Spain tax the months before?

    It can. Spain has no split year. On the regular rules, if you are resident in the year you arrive, Spain taxes your worldwide income for that whole year, including the months before the move. Under Beckham it works differently. Big sales are best timed before that year starts.

    I'm under Beckham. Do I still file?

    Yes, Modelo 151 every year in the Renta window. Modelo 720 is not required under Beckham. The tax agency's guidance does not cover Modelo 721 under Beckham, so we decide it case by case.
